Five rules that protect the system
The value of Pacto rests on trust between companies and freelances. These rules are not negotiable: they are the product.
Pacto never touches the funds
Payments go directly from the company to the freelance. Pacto sells a right to use the system and access to its network; it neither collects nor pays out on behalf of third parties, and provides no payment service. Your flows stay between you.
Balances are never written off
A balance created is owed until it is fully settled, however long that takes. It carries over month after month, survives the freelance's departure and the end of the programme. Transparency is total: everyone sees their balance at any time.
Closing a programme requires settling its debts
A company may stop whenever it wishes, provided it has settled its debts towards its freelances. This rule, at the heart of the model contract, is the guarantee that makes spread payment acceptable.
The activation fee filters for seriousness
Access to the network of members is paid at the door. A company that cannot commit 1,000 EUR is not in a position to run a spread payment programme: the filter protects the freelances of the network, and therefore everyone's reputation.
Autonomy is the condition of admission
No subordination, no detailed specification, no exclusivity. Cards with an objective and a volume, taken freely by professionals operating as companies. That is what makes the arrangement hold, legally and humanly.
In case of disagreement
The model contract provides for mediation first, courts afterwards. Each party always keeps a remedy: no waiver is imposed on anyone.
Your data
Balances, payments and missions are processed in accordance with the GDPR. Every member has their rights of access, rectification and erasure.
The contract prevails
This site is an information document. In case of divergence, the contract signed between the company and the freelance, and it alone, is authoritative.
